Article II. OPERATION OF DENVER MUNICIPAL AIRPORT SYSTEM |
§ 5-16. Rules and regulations.
(a)
The manager of aviation shall have power and authority, and is hereby empowered and authorized, to adopt rules and regulations for the management, operation and control of Denver Municipal Airport System, and for the use and occupancy, management, control, operation, care, repair and maintenance of all structures and facilities thereon, and all land on which Denver Municipal Airport System is located and operated.
(b)
The manager of aviation shall have power and authority, and is hereby empowered and authorized, upon the basis of traffic engineering or other investigations and studies or where necessitated by the peculiar character of Denver Municipal Airport System as an airport, to adopt rules and regulations pertaining to the operation of automobile and vehicular traffic and parking facilities on Denver Municipal Airport System, except that certain street or public highway known and designated as Havana Way as established by Ordinance No. 127, Series 1954, further excepting that certain street or public highway known and designated as Havana Street lying fifty (50) feet on each side of the east line of Section 27, Township 3 South, Range 67 West of the Sixth Prime Meridian, north of a point 72.9 feet south of the northeast corner of the southeast One-Quarter of such Section 27. By way of example, but not by way of limitation, such rules and regulations may provide for the following:
(1)
Establishment of zones for special parking;
(2)
Establishment of zones for the loading and unloading of passengers and for the deliveries of goods, and time limitations thereon;
(3)
Designation of bus stops;
(4)
Fixing of speed limits;
(5)
Establishment of minimum equipment requirements for automobiles and other motor vehicles;
(6)
Installation of traffic-control signs, signals and devices for the regulation of traffic;
(7)
Establishment of accident reporting procedures;
(8)
Establishment of right-of-way regulations;
(9)
Prescribing methods of parking;
(10)
Designation of one-way and through traffic roadways, driveways and thoroughfares.
(c)
The manager of aviation shall have power and authority, and is hereby empowered and authorized, upon the basis of passenger flow or other investigations and studies or where necessitated by the peculiar character of Denver Municipal Airport System as an airport, to adopt rules and regulations pertaining to the sale, offering for sale or furnishing of any commodity, article, facility or service upon Denver Municipal Airport System. By way of example, but not by way of limitation, such rules and regulations may provide for the following:
(1)
Conducting such activities in such manner as to minimize or avoid congestion of areas commonly used by the public;
(2)
Prescribing or approving methods to be used in conducting such activities;
(3)
Ensuring that such activities will not be a fraud on the public;
(4)
Designating areas upon Denver Municipal Airport System in which such activities may be conducted.
(d)
The manager of aviation shall have the power and authority, and is hereby empowered and authorized, upon the basis of passenger flow or where necessitated by the peculiar character of Denver Municipal Airport System as an airport, to adopt rules and regulations pertaining to the exercise of First Amendment rights, including by way of example, but not by way of limitation, solicitation of contributions for charitable or religious purposes and the dissemination of printed material upon Denver Municipal Airport System. Such rules and regulations shall establish reasonable time, place and manner guidelines for the exercise of such First Amendment rights.
(e)
The manager of aviation shall have the power and authority and is hereby empowered and authorized to establish and set rates, fees and charges as shall be necessary to meet the needs for operating the Denver Municipal Airport System including without limitation the expenses for bonded indebtedness of the system, its operating expenses, and expenses for construction, reconstruction, replacement, repair and any similar activity for any facility within the system. The manager of aviation shall be further empowered, consistent with all applicable bond ordinances, to reasonably apportion these expenses among the airlines, concessionaires, businesses and other users of the system based upon their present or future projected use of the facilities.
(f)
It shall be unlawful for any person to violate any such rule or regulation promulgated by the manager of aviation pursuant to this article; provided, however, that the violation of any rule or regulation promulgated pursuant to subsection (b) of this section 5-16 for which there is an identical or substantially similar counterpart in chapter 54 of this Code which is declared to be a noncriminal traffic infraction shall, likewise, be considered a civil matter and shall be subject to like penalties, upon admission or finding of guilt or liability, by default or otherwise.
(g)
The Rules and Regulations for the Management, Operation, Control and Use of the Denver Municipal Airport System previously adopted by the manager of public works and in effect as of June 30, 1994, or thereafter are hereby ratified and adopted as Rules and Regulations for the Management, Operation, Control and Use of the Denver Municipal Airport System of the Manager of Aviation and shall be effective until such time as the manager of aviation shall adopt successor or amending regulations, provided that all references in such rules and regulations to the manager of public works shall mean the manager of aviation.
