Any automobile or other motor vehicle which shall be left parked on any public parking
lot at Denver Municipal Airport System for a period of thirty (30) days or more shall
be presumed to have been abandoned by the owner or operator thereof and is declared
to be a public nuisance, and upon the expiration of the thirty-day period the manager
of aviation may cause the vehicle to be removed to a public pound or other place of
storage. After such removal the manager of aviation shall give notice of such removal
by certified mail to the owner, if known, of the vehicle at the owner's last known
address, and such vehicle shall be returned to the owner upon the payment to the city
of the costs of removal, parking charges accumulated on the vehicle at the airport,
and a penalty of ten dollars ($10.00). If the manager of aviation is unable through
reasonable and diligent means to locate the owner thereof, or the owner fails or refuses
to pay such charges and redeem the vehicle within fifteen (15) days after the mailing
of such notice or request a hearing as hereinafter provided, the vehicle shall be
advertised for sale at public auction at least once, not less than ten (10) days prior
to the proposed sale, in the official newspaper of the city and sold by the manager,
unless the same shall be sooner reclaimed and the costs, parking charges and penalty
paid by the owner. Any person who is aggrieved by this procedure may request a hearing
before the manager's designated hearing officer for parking at the airport, pursuant
to the rules and regulations for the operation, management and control of the airport.
The proceeds of such sale shall be paid into the airport revenue fund, to be applied
first toward the costs and penalty, and then toward parking charges (to be allocated
between the city and parking lot concessionaire, if any), and the balance shall be
refunded to the person furnishing proof of ownership of the vehicle satisfactory to
the manager of aviation, provided proof is made within six (6) months after such sale.
