§ 2-91. Definitions.

  • When used in this article:

    (1)

    Adopting authority shall mean any officer, employee, agent or agency of the city, authorized by law to make rules and regulations, including departments, boards, commissions or members thereof.

    (2)

    Ordinance shall mean any ordinance enacted by the city council and shall include any code or compilation of ordinances, or any part thereof, enacted under the authority of council.

    (3)

    Rules, regulations, or rules and regulations shall mean the whole or any part of rules or regulations adopted pursuant to Charter or ordinance authority, and includes modifications and amendments, but shall not include the following: personnel rules and rules relating to personnel systems; rules of or by the judicial branch of the City and County of Denver; rules necessary for the internal security of departments or agencies dealing with the hazards of fire, air travel, law enforcement, or the custody of those charged with or convicted of crimes or misdemeanors; executive orders; rules relating to internal operations, management or procedure; or rules and regulations required by Charter, such as those required to be made by city council under Denver Charter section B1.7, or for which rule-making procedure is provided by the Charter or by specific ordinance; provided that rules relating to cable television permits or operations adopted by the city council shall not be excluded from the operation of this article. In addition, operational rules and regulations relating to the airport system which are applicable to airlines, tenants or commercial users and not the general public, including rates and charges, may be adopted by complying with the provisions of section 2-96(1), with the exception of referenced section 2-94(1) procedures, and the remainder of this article VI, chapter 2 shall not be applicable so long as the director of aviation makes a good faith effort to notify and receive input from people or companies who will be subject to such regulations.

    (4)

    Rule-making shall mean the process by which an adopting authority adopts, re-adopts, amends or repeals rules or regulations.
