§ 49-299. Council's reserve powers.

  • The city council expressly hereby reserves the right:

    (1)

    To proceed to the creation of a local improvement district for the purpose herein specified without the necessity of a petition therefor in those cases where the council finds that the danger to the safety of children is particularly great;

    (2)

    To permit interested persons to appear and speak in case of a public hearing as set out in section 49-297 whether they have filed written objections within the time provided in section 49-297, or not;

    (3)

    To change the boundaries of the proposed local improvement district by the exclusion therefrom of any tract or tracts which the council shall find not to be specially benefitted by the proposed improvement; or by the inclusion therein of other tracts, not included within the proposed local improvement district, which the council finds will be specially benefitted thereby;

    (4)

    To change the boundaries of the zones in accordance with the special benefits as found by the council; and

    (5)

    To modify, in accordance with the findings of the council as to benefits, the relative proportions of the cost of the improvement to be borne by and assessed against the lands in the several zones of the district in case there are more than one (1) zone.
