§ 55-420. Definitions.

  • The following terms shall have the following definitions for purposes of this article:

    (a)

    Business: means any business or commercial operation or establishment, whether operated for profit or not for profit, including but not limited to hotels, motels, restaurants, taverns, retail stores, funeral homes, office buildings, schools, colleges, wedding and reception halls, theatres, concert halls, and hospitals. The term does not include private residences.

    (b)

    Director: means the Director of Excise and Licenses.

    (c)

    Entity: means a corporation, limited liability company, limited partnership or partnership.

    (c.1)

    Face block: means a zone lot or lots fronting on one (1) side of the block. The "same" face block indicates only those lots fronting on the same side of the block as the subject property. The "facing face block" includes those zone lots located on a different block than the subject property, but located directly across the street from and fronting the same street as the subject property, and bounded by the same intersecting streets as the subject property's block.

    (d)

    Hire: means to employ, contract with, or utilize.

    (e)

    Person: means a natural person; not an entity.

    (f)

    Premises: means private real property owned, leased, or licensed to the valet client business.

    (g)

    Temporary valet parking sign: means a movable sign placed on the public right-of-way stating or advertising that valet parking is available at the valet client business.

    (h)

    Valet attendant: means any person hired by a valet operator to perform valet services for the valet operator, a valet client business, or the valet client business's valet customers.

    (i)

    Valet client business: means a business that hires a valet operator to perform valet services for valet customers of the business.

    (j)

    Valet customer: means the customer, employee, visitor, or other person who owns, leases, or has the lawful right to possess the motor vehicle that receives parking valet services while visiting, working at, occupying, or patronizing the valet client business and all drivers and passengers of such motor vehicle.

    (k)

    Valet drop-off location: means a place at or near the valet client business's location where valet customers and their passengers embark and disembark from their vehicles and load or unload their motor vehicles when utilizing valet services at the valet client business.

    (l)

    Valet operator: means any person or entity hired as an independent contractor by a valet client business to perform valet services for the valet client business or the valet client business' valet customers. The term includes the valet client business itself where the valet client business elects not to hire a parking valet operator as an independent contractor, but instead performs parking valet services for its valet customers through its own employees.

    (m)

    Valet parking lot: means a parking lot or lots or other place or places where the valet operator or valet attendants park one (1) or more valet customers' vehicles until the vehicle is retrieved by a valet operator, valet attendant, or the valet customer. There shall be no on-street valet parking.

    (n)

    Valet parking receipt: means a piece of paper or token with a unique number, letter, or symbol which identifies and connects the valet customer with his or her motor vehicle, which is issued in triplicate, one (1) copy of which is given to the valet customer, one (1) copy of which is attached to the key to the valet customer's motor vehicle and kept at the valet station, and one copy of which is left in the interior of the valet customer's motor vehicle on the dash or at some other place where the receipt is visible from the exterior of the vehicle when looking at or through the windshield of the motor vehicle.

    (o)

    Valet parking services: means the act of driving a motor vehicle to park or retrieve the motor vehicle for a valet customer while the valet customer visits, works at, or patronizes a valet client business. The term does not include merely loading or unloading people, animals or cargo from a motor vehicle, opening or closing doors of motor vehicles, greeting customers and patrons in motor vehicles, giving directions for parking, or providing parking spaces.

    (p)

    Valet parking station: means a table, podium, desk, or similar place at or near the valet client business where one (1) copy of the valet parking receipts and keys to the valet customers' vehicles are kept and where valet customers may go to drop off or retrieve their motor vehicles or the keys to their motor vehicles.
