§ 54-549. Display of banners and signs on overpasses prohibited.

  • (a)

    The purpose of this section is to prevent dangers to persons and property, to prevent delays, and to avoid interference with the traffic flow on roadways underneath overpasses. Overpasses that direct traffic over roadways are designed to deal with specific traffic flow problems. The presence of persons on overpasses, who are displaying banners or signs directed at the motorists below, poses dangers to traffic, regardless of the content of their message.

    (b)

    It shall be unlawful for any person to display, or to jointly display with any other person(s), while on any overpass above a roadway, any banner, sign, poster, or other written message or visual symbol so as to knowingly direct such communication to motorists driving on the roadway below, regardless of the content of the message.

    (c)

    The provisions of this section shall not prohibit any temporary or permanent installation, use, or display of an official or authorized traffic-control device by authorized federal, state, or municipal agencies, officials, or employees, or to prohibit the use of motorist services information of a general nature on official highway guide signs.
