Article XI. PROTECTION OF IRRIGATION DITCHES |
§ 49-301. Formula for fixing assessment.
(a)
The cost of improvement shall be borne by the property to be specially benefitted, except as stated in this article.
(b)
In case there is only one (1) zone, the cost shall be divided pro rata on the entire acreage in the district except that included in public streets, roads and highways.
(c)
If there is more than one (1) zone in the district, the division shall be in the same manner, except that adjustment shall be made for the several rates fixed for the different zones.
(d)
The ordinance shall specify the maximum rate of assessment, which shall be based upon the engineer's estimate of total cost, including a reasonable percentage for the cost of collection and other incidentals and of interest to the time the first installment falls due.
