§ 49-291. Authority.

(a)

The city shall have the power to cover or otherwise protect irrigating ditches or any parts thereof which lie within any thickly settled residence portion of the city; and to assess the cost thereof upon the property especially benefitted thereby.

(b)

All contracts therefor shall be awarded by the mayor, upon the recommendation of the manager of public works.

(c)

All such improvements shall be constructed by and under the direction of the manager of public works, in accordance with specifications prescribed by the manager, provided, however, that the covering or otherwise protecting of any irrigating ditch, or of any portion thereof, shall first be authorized by the council.
