§ 48-94. Unlawful to litter embankments, waters, streams or watercourses.

  • It shall be unlawful for any person to dump, deposit, throw, drop, place or leave, or to cause or to permit the dumping, depositing, throwing, dropping, placing or leaving of any litter into any lake, pond, reservoir, waters, stream or watercourse, or upon any embankment, unless:

    (1)

    Such property is an area designated by the city or by any of its agencies, for the disposal of litter;

    (2)

    Such litter is placed in a receptacle or container installed on such property for the purpose of containing litter;

    (3)

    Such person is the owner or tenant in lawful possession of such property, or has first obtained written consent of the owner or tenant in lawful possession; or

    (4)

    Such act is done under the personal direction of the owner or tenant in lawful possession of such property.
