§ 43-5. Safety precautions and devices at 43rd near Galapago Street.

  • (a)

    The Colorado and Southern Railway Company; Chicago, Burlington & Quincy Railroad Company; and The Denver and Salt Lake Railway Company be and they hereby are required to together furnish, station and maintain a watchman, between the hours of 7:15 a.m. and 9:30 a.m., and between the hours of 2:00 p.m. and 4:30 p.m., on each public school day during each public school term, on West 43rd Avenue, between Galapago and Inca Streets, in the city, where the rights-of-way of such company are crossed by the West 43rd Avenue.

    (b)

    The Colorado and Southern Railway Company; the Chicago, Burlington & Quincy Railroad Company; and The Denver and Salt Lake Railway Company are required to furnish, install and maintain at West 43rd Avenue and Galapago Street a signal device which will flash a red light and ring a bell or gong thereon whenever a locomotive or train of cars is approaching such crossing on such company's main line, provided, however, if any of such companies shall elect to, and shall, stop all locomotives or trains of cars moving on its main line, before proceeding over said crossing and have such locomotive or train of cars preceded thereover by an employee, such company shall not be required to furnish or maintain or participate in the furnishing or maintenance of such signal; and provided further, none of such companies shall be required to stop its locomotives, cars or trains, or send an employee ahead thereof over said crossing, while the watchman provided for in subsection (a) is on duty.
