§ 39-171. Definitions.

  • The following words and phrases, when used in this article, shall have the meanings respectively ascribed to them:

    (1)

    South Platte River Greenway. Any real property currently or hereafter established by ordinance as being part of the official channel of the South Platte River as it is situated within the jurisdictional boundaries of the City and County of Denver and any included real property, such as city park land, city property, other governmental property, private property, and the Platte River Trail, located adjacent to, or in the immediate vicinity of, the official channel or other portions of the channel of the South Platte River.

    (2)

    Cherry Creek Greenway. Any included real property, such as city park land, city property, other governmental property, private property, and the Cherry Creek Trail, located adjacent to, or in the immediate vicinity of, the channel of Cherry Creek.

    (3)

    Official channel of the South Platte River. This area is identified by name on the quarter section maps of the South Platte River on file in the office of the city engineer within the department of public works.

    (4)

    Included real property. Publicly and privately owned real property specified by interdepartmental agreement, executive order, cooperative agreement, conservation easement, or private easement or agreement, as appropriate, as part of the South Platte River Greenway or the Cherry Creek Greenway under this article.

    (5)

    City park land. Any real property, including parks, parkways and other recreational facilities, as well as other land, waterways and water bodies, owned, operated or controlled by the department of parks and recreation.

    (6)

    City property. Any real property, including land, waterways and water bodies, owned, operated or controlled by any department, office, agency, board, or other subsidiary of the City and County of Denver, except the department of parks and recreation.

    (7)

    Other governmental property. Any real property, including land, waterways and water bodies, owned, operated or controlled by any governing body, department, agency or political subdivision of the federal government and the state, except the City and County of Denver.

    (8)

    Platte River Trail. The existing or hereafter constructed pedestrian and bike pathway located in or along the official channel of the South Platte River, including those portions located by easement upon private property.

    (9)

    Cherry Creek Trail. The existing or hereafter constructed pedestrian and bike pathway located in or along the channel of Cherry Creek, including those portions located by easement upon private property.

    (10)

    Conservation easement. As defined and provided for in Article 30.5 of Title 38 of the Colorado Revised Statutes.

    (11)

    Cooperative agreement. As provided for in section A4.4-6 of the City Charter.
