§ 39-132. Recommendation of compatible nonpark use by the board.

  • The board, upon receipt of a referral from the manager for a recommendation of a compatible nonpark use or uses for a qualifying structure, shall:

    (1)

    Request the manager to notify all registered neighborhood organizations that will be affected or which are within the area served by the park in which the qualifying structure is located at least forty-five (45) days prior to the time set by the board for a meeting for public comment that:

    a.

    The described qualifying structure has been referred to the board;

    b.

    The board will study and recommend to the manager a compatible nonpark use or uses for the structure;

    c.

    A meeting for public comment will be held in accordance with the rules of the park and recreation advisory board to discuss possible compatible nonpark uses;

    d.

    The time, date and location of the public meeting; and

    e.

    Request statements of suggested uses for a qualifying structure and that such statements may be submitted to the board not later than ten (10) days before the meeting. Statements of suggested uses must contain:

    1.

    A description of the suggested use for the qualifying structure and its impact on the park;

    2.

    A preliminary analysis of the necessary remodeling and repairs required to make the qualifying structure useable for the proposed use;

    3.

    A preliminary analysis of the traffic that will be generated by the proposed use and the parking that will be required for the proposed use;

    4.

    A preliminary economic analysis showing the financial viability of any use suggested; and

    5.

    Such other information that the board determines may be useful.

    (2)

    In determining the neighborhood organizations to be notified, the manager shall consider whether the park is in or near a neighborhood; the size of the park; and the type of facilities located at the park and recommendations from the board. All neighborhood organizations adjoining or including the park shall be notified.

    (3)

    After posting notice for not less than fifteen (15) consecutive days, hold a meeting for comment to discuss possible compatible nonpark uses.

    (4)

    Consider all suggestions submitted either in writing or at the meeting for public comment and make a recommendation to the manager concerning a compatible nonpark use or uses for the qualifying structure. The recommendation shall include methods for limiting the impacts on park uses and copies of all written suggestions for use of the qualifying structure.
