§ 34-81. Sheriff's sale and distribution of proceeds.

    If the obligor has failed to contact the child support division or reach a settlement as described in section 34-79 or section 34-80, the sheriff, in coordination with the child support enforcement division, may proceed with sale of the motor vehicle after seizure. The sheriff's sale is pursuant to a writ of execution as authorized by C.R.S. 13-52-102(1) (as amended).

    The process for the sheriff's sale will be pursuant to the Writ of Execution and shall comply with all statutory requirements. All towing fees, storage fees, publication fees and all other fees incurred pursuant to C.R.S. 30-1-104 (as amended) will be paid first, out of the proceeds of the sheriff's sale. The remaining balance of the proceeds will then be paid to the child support division. Proceeds may also be distributed pursuant to C.R.S. 13-55-109 (as amended). The child support division will deposit the sale proceeds into the family support registry for appropriate distribution pursuant to C.R.S. 26-13-119 (as amended).
