§ 34-78. Negotiated settlement and default after settlement.

    The child support enforcement division shall offer a settlement if the obligor timely responds to the notice of intent. The acceptable settlement conditions at a minimum shall include a lump-sum payment of one (1) percent of the arrearages owed plus one thousand dollars ($1,000.00). The settlement shall also include additional monthly payments towards the arrearages and payment of the full monthly current child support for at least six (6) months. The amount of payment on the arrearages may be negotiated between the obligor and the child support enforcement division, but the minimum payment shall be at least one hundred dollars ($100.00) per month. Payments are to be by immediate income assignment if the obligor is employed.

    If the obligor defaults on the payments as agreed after settlement, the child support enforcement division may file a writ of execution without further notice to the obligor.
