§ 22-82. Restrictions on transportation of hazardous and radioactive materials.

  • (a)

    Hazardous materials required to be placarded under 49 Code of Federal Regulations Part 172, as amended, and radioactive materials subject to regulation under 10 Code of Federal Regulations section 71.5, as amended, may not be transported within the city except on the streets, highways, or other public ways designated by the city traffic engineer and the manager of safety pursuant to section 54-649. Transportation of hazardous and radioactive materials shall not deviate from the routes designated on the route map except as provided in section 54-648.

    (b)

    Notwithstanding the provisions of subsection (a) of this section, the following materials may not be transported along the elevated portion of Interstate 70 from Colorado Boulevard to the Washington Street exit.     Class A explosives (49 C.F.R. 173.53).

    Class B explosives (49 C.F.R. 173.88).

    Class A poisons (49 C.F.R. 173.326).

    Organic peroxide (49 C.F.R. 173.151a).

    Radioactive material subject to regulation under 10 C.F.R. 71.5.

    (c)

    Notwithstanding the provisions of subsection (a) of this section, the following materials may not be transported along the elevated portion of Interstate 70 from Colorado Boulevard to the Washington Street exit during the traffic rush hours of 6:30 to 8:30 a.m. and 4:00 to 6:00 p.m. on any day other than Saturday, Sundays and holidays, as defined in section 54-1(22). Citation in parenthesis refers to the appropriate section of the Code of Federal Regulations.)

    Flammable liquids (49 C.F.R. 173.115).

    Propane (49 C.F.R. 172.101).

    (d)

    Notwithstanding the provisions of subsection (a) of this section, the materials listed below may not be picked up or delivered within the restricted area of the city, as designated in the route map adopted pursuant to section 54-649 during the traffic rush hours of 6:30 to 8:30 a.m. and 4:00 to 6:00 p.m. on any day other than Saturdays, Sundays and holidays, as defined in section 54-1(22).     Class A explosives (49 C.F.R. 173.53).

    Class B explosives (49 C.F.R. 173.88).

    Class A poisons (49 C.F.R. 173.326).

    Flammable solids (49 C.F.R. 173.150) which require the "DANGEROUS WHEN WET" label as specified in 49 C.F.R. 172.101.

    Liquefied petroleum gases (49 C.F.R. 172.101).

    Flammable liquids (49 C.F.R. 173.115).

    Flammable cryogenics (40 C.F.R. 173.300(f)).

    Organic peroxide (49 C.F.R. 173.151a).

    Radioactive material subject to regulation under 10 C.F.R. 71.5.

    (e)

    The manager of safety may require on a case-by-case basis, advance notification, police escorts or inspections of any cargoes deemed to present special risks if emergency response capability in his judgment can be enhanced by such measures.
