§ 1-12. Severability.

  • If any provision of this Code or any provision of any rule or regulation lawfully promulgated hereunder or any application of this Code or rule or regulation promulgated hereunder to any person or circumstance is held invalid or inoperative, such invalidity or inoperativeness shall not affect other provisions or applications of the Code or rules or regulations. The council hereby declares that in these regards the provisions of this Code and all rules and regulations promulgated hereunder are severable.

    Case Law annotation— If a valid, complete, enforceable provision remains, the invalid provision should be stricken. E.O. Geer v. Alaniz, 138 Colo. 177, 331 P. 2d 260 (1958).

    Severability clause means if a complete valid law remains after invalid portions are stricken, the court should so hold. Crawford v. Denver, 156 Colo. 292, 398 P. 2d 627 (1965).
